British Columbia’s environmental laws impose liability for environmental clean-up costs on any owner of land that is contaminated. An owner includes someone who is acting as an executor or trustee of an estate. As a result, we need to consider the environmental laws if these laws may apply to you. Please answer the following questions assuming that the activities referred to means chemical, construction, dry-cleaning, electrical, electronic, laboratory, machinery, metal fabrication, photo development, printing or publishing, service stations, textiles and wood preservation, vehicle maintenance or transportation or other similar activities.

Choosing an executor for your will is very important. Your executor(s) will receive an executor’s fee from your estate (determined by the law) for their services unless you instruct us otherwise.

The remainder of your estate will consist of everything that is left after payment of all your debts, liabilities and taxes as well as the payment of specific gifts that you have indicated above. In this section, you tell us what you want to do with the rest of your estate.

Provisions for your Children
If you have minor children (or a mixture of minor and adult children), it is a good idea to set up a trust for them until they reach an age of your choice. Prior to this age, your trustee will be given the power to pay out funds for the children’s benefit (such as for education, health and other living expenses). Once they reach this age (or if they are already this age when you die), they will receive their portion of the trust funds absolutely. If you have only adult children, you can describe how you wish to provide for them at the end of this section.
Guardians for Minor Children
If you have any children who are under the age of majority (19 in British Columbia), it is important that you name a guardian for them who will be legally responsible for their care. If you do not name a guardian, a court application would have to be made in order to select a guardian.

If the above provisions fail for some catastrophic reason, how do you want the rest of your estate to be distributed? In other words, who would be the alternative beneficiaries? For charities, please indicate the name of the charity after reading the note below (e.g. 50% to my friend, John Alexander Doe, of 123 Main St., Vancouver, BC and 50% to University of British Columbia).

Your will should grant certain powers to your executor in order that she or he can administer your estate efficiently. We generally include a fairly extensive set of powers that gives the executor a great deal of flexibility in administering and investing your estate. You can either direct us to include our “standard” set of powers or you can give us specific instructions on what types of powers you would like your executor to have.
